Family Dispute Resolution (FDR)
Family Dispute Resolution is a structured mediation process that helps separating and separated parents discuss and resolve issues relating to their children and future parenting arrangements.
Working with a qualified Family Dispute Resolution Practitioner, parents are supported to identify concerns, explore options and develop workable agreements focused on the best interests of their children.
This process is conducted in accordance with the Family Law Act 1975, including recent legislative amendments.
Intake and Assessment
Before mediation can proceed, each participant attends an individual Intake and Assessment appointment.
These confidential meetings provide an opportunity to:
• Discuss your circumstances and concerns
• Identify your goals for mediation
• Assess suitability for the mediation process
• Consider any safety concerns or barriers to participation
• Explore available support and referral options
Mediation is voluntary and may not be suitable for every situation. The Intake and Assessment process helps ensure that the most appropriate pathway is identified for all participants.
Parenting Arrangements
When parents separate, decisions about children’s care and wellbeing can be difficult.
Mediation provides an opportunity to discuss:
• Living arrangements for children
• Schooling and education
• Health and medical needs
• Communication between parents
• Holiday and special occasion arrangements
• Relationships with extended family and significant people
Parenting arrangements should focus on the child’s emotional, physical, educational and developmental needs, with their best interests remaining the central consideration.
Agreements reached during mediation may be recorded in a Parenting Plan, and in some circumstances parents may choose to seek legal advice about formalising their arrangements through Consent Orders.
